FETCH KEY TERMS AND CONDITIONS

We know it's really hard sometimes to read through a long set of Terms and Conditions.

To help you navigate, we've summarised what we think are the most important things to know about your subscription to Fetch.

Just remember, this is only the summary, so be sure to look up the full terms and conditions following this summary if you need more detail on how they apply to your Fetch Service.

YOU'RE SIGNING UP FOR FETCH ACCESS

  • You're subscribing to Fetch which is an entertainment service delivered using a set-top-box as the access device. Set-top-boxes do not operate standalone and require the Fetch Service to function.
  • You are signing up for a monthly subscription that includes a variety of included entertainment and core features of the Fetch Service explained more below.
  • These terms set out your rights as well as your responsibilities when you sign up for Fetch. Once you activate your Fetch account you're accepting these terms and they'll apply from that point on.
  • These Terms apply to retail customers who purchase a Fetch TV Box from a retail store or for customers who formerly had an agreement with an internet service provider (ISP) for delivery of the Fetch Service but have had their agreements with the ISP transferred. If you continue to be billed for your Fetch service through your internet service provider (ISP) these terms and conditions apply in addition to any terms and conditions specifically imposed by your ISP.
  • By using Fetch you're accepting these terms.

FETCH PRODUCTS, SERVICE AND PRICES

  • First you need to PURCHASE a FETCH SET-TOP-BOX of your choosing - either a Mini hub or Mighty PVR. Prices may vary between retailers and the Fetch online store. Check the Fetch website for pricing on Fetch. You will own the set-top-box outright once you purchase it, but you must maintain a subscription to use it.
  • An ACTIVATION FEE is payable as a once-off charge when you create your new Fetch account. You will only pay an activation fee for the first time you set up your household account.
  • To use your Fetch set-top-box, an active Fetch subscription is required, with the minimum monthly subscription being the Fetch Access.
  • The fee for FETCH ACCESS is payable monthly for the service. Check the website and price list for the current fee. For Fetch Access you get: All free to air channels whether or not you have an antenna (provided you have a compatible device), 30 included lifestyle, general entertainment and special interest channels, 30+ games, access to streaming apps, rentals and purchases the movie and tv store and Movie Box (50 curated on-demand movies each month) plus all the functions of the Fetch Service including the user interface, universal voice search and recording if you have a Mighty set-top-box.
  • The Fetch Access Subscription is charged to NEW CUSTOMERS SIGNING UP FROM 1 DECEMBER 2025 AND FROM 4 SEPTEMBER 2026 TO EXISTING CUSTOMERS ACTIVATING A NEW SET TOP BOX.
  • Once you have purchased your set-top-box, the TOTAL FIRST YEAR COST to access the Fetch Service if you don’t want to pay for any other content is $65.88 (including the one-off Activation fee) as at the date of this summary document.
  • You may also choose to subscribe to additional content options on a monthly basis, it's up to you.
  • Full pricing is available at www.fetchtv.com.au/plans and also accessible by using the QR Code on your Fetch Box pack and at this link.
  • Content apps such as Netflix, Disney+ and Paramount+ require separate subscriptions which are not included in Fetch pricing. Your use of content apps are regulated by that platform's terms and conditions or end user license terms.

EXTENDED SERVICE LEVY (ESL) FOR LEGACY HARDWARE

  • If you are a legacy retail customer using older Generation 3 (Gen 3) hardware that is over 5 years old and you do not pay the monthly Fetch Access Fee or maintain an active paid monthly Content Pack, Fetch Access or pay for Multiroom, an Extended Service Levy (ESL) of $29.99 applies to your account from 1 November 2026.
  • The ESL is a one-off fee covering a 12-month period that helps offset the rising operational costs of maintaining legacy infrastructure, security updates, network compliance, and technical support for older devices.
  • Maintaining an active monthly Content Pack or Fetch Access subscription or paying for Multiroom exempts you from the ESL. If an ESL payment fails, your account will be suspended and your legacy device will lose connectivity until cleared.
  • The ESL supports platform baseline connectivity for legacy devices but does not fund new feature development or third-party app compatibility.
  • If you do not wish to pay the ESL, or take any of the steps that would exempt you from payment (maintain an active monthly Content Pack or Fetch Access subscription or paying for Multiroom) you may terminate your Fetch Service.

YOU CAN CANCEL ANYTIME

  • You can cancel Fetch whenever you like at www.fetchtv.com.au/account.
  • Cancellation will take effect at the end of the month in which you cancel. You'll continue to enjoy access until then, and billing will stop once the cancellation has taken effect.
  • You need to know that if you do choose to cancel and stop paying for the Fetch Access Subscription, you will no longer be able to use the Fetch set-top-box. You will lose access to your recordings and any purchases through the TV and Movie Store.
  • You can re-start your subscription at any time again though, and your set-top-box will be re-activated to access the Fetch service. However, you will not be able to access your recordings and purchases.

MULTI-ROOM

  • You can connect up to 3 Fetch set-top-boxes under one account in the same home. You won't pay another Activation Fee for additional boxes connected.
  • If you already are a Fetch customer using Multi-Room and you decide to add another set-top-box to your account, then you will start to pay a separate monthly Multi-Room Fee. This is only charged on a household basis, not per set-top-box.
  • For new Fetch customers from 1 February 2026 you will pay an additional monthly Multi-Room Fee per household to have up to 3 set-top-boxes connected to your account.
  • For all Fetch customers, we will not charge you the Multi-Room Fee until 1 February 2026.

FETCH SET-TOP-BOXES

  • You need a Fetch set-top-box to access the Fetch service on your TV, mobile or tablet. To use your Fetch set-top-box, you must have an account and have subscribed to pay the ongoing Fetch Access Subscription which includes a variety of content and features.
  • Current generation set-top-boxes are the Generation 4 Mighty and the Generation 5 Mini. Older generations of set-top-boxes may not support all functionality, including not all apps.
  • Retail set-top-boxes include a manufacturer's warranty. Please look after your set-top-box and accessories to avoid damage. A failure to do so may void your warranty. Of course, you always have your consumer rights under the Australian Consumer Law. The warranty terms can be accessed from the QR code on your set-top-box packaging or from our website.
  • Once you have an account and have activated your set-top-box, Fetch can also be accessed via the Fetch Mobi app on your iOS or Android mobile phone or tablet once the app has been linked to your Fetch account.
  • Features and content available to you may differ depending on your set-top-box or device type.

CONTENT, RECORDING, COPYRIGHT AND ARTIFICIAL INTELLIGENCE

  • Fetch provides access to free-to-air TV (via antenna, eligible BVOD apps and as internet-delivered channels), streamed TV channels, optional content subscription packs, movie rentals/purchases, access to streaming apps and games.
  • Copyright rules apply to all content. This means that: you may not copy, resell, screen publicly, or re-distribute Fetch content; some content cannot be recorded (including movies you rent or purchase, internet-delivered free-to-air channels and virtual playlist channels); you will not use artificial intelligence in connection with any Fetch content; your use is for personal, non-commercial purposes only. Our content contracts prohibit any use of AI in connection with the content on the Fetch Service.
  • You do not own recorded content and these remain subject to Copyright rules and Rights availability. Should content rights change or be removed from Fetch, related recordings of that content will also be removed from your set-top-box. If your set-top-box malfunctions and you lose any recordings, you are not entitled to compensation from Fetch TV.
  • If Fetch is used in a way that breaches these Terms, the service may be suspended or terminated and additional action may be taken.

RENTED AND PURCHASED MOVIES & SHOWS

  • Rented titles are available for a limited time, and purchased titles remain accessible only while you retain a Fetch account.
  • If you cancel your Fetch service, access to purchased content is permanently lost, even if you reactivate your account later.

USER REQUIREMENTS

  • You must be 18 years of age to set up a Fetch account. Fetch can only be used in Australia.
  • Fetch needs broadband internet of at least 3 Mbps per set-top-box to work. You must also have a working video screen, speakers and spare HDMI port to connect the Fetch set-top-box to your equipment.
  • Your internet provider's (ISP) data charges and broadband quotas apply whether or not your account is directly with Fetch or an ISP.

YOUR PRIVACY

  • By entering into this agreement, you consent to Fetch collecting, using, and disclosing your personal information (including contact details, device information and some viewing activity) to provide and improve the service. Fetch may also use your data for the purposes of selling and delivering advertising on the Fetch service.
  • Fetch handles all personal information in accordance with our Privacy Policy: www.fetchtv.com.au/privacy-policy.

CHANGES TO THE SERVICE

  • Prices, content, and features may change.
  • We will provide at least 21 days' notice of changes to these Terms and 30 days' notice of price or material content changes, unless the change is outside our control.
  • If a change significantly disadvantages you, you may cancel Fetch.

Fetch TV Retail Terms of Use

EFFECTIVE: 15 September 2026

Important: What You Need to Know Upfront

  • This document sets out the terms of use by which Fetch TV Retail Pty Ltd or its affiliates ("we" and "us") will supply the Fetch Service (Fetch) to You (the "Agreement").
  • Who These Terms Apply To: These terms and conditions are for customers who purchase a Fetch TV Box from a retail store or for customers who formerly had an agreement with an internet service provider (ISP) for delivery of the Fetch Service but have had their agreements with the ISP transferred1. If you continue to be billed for your Fetch service through your internet service provider (ISP) these terms and conditions apply in addition to any terms and conditions specifically imposed by your ISP. In the event of any conflict or inconsistency between the terms and conditions imposed by your ISP and these Fetch Terms of Use, the terms and conditions of your ISP shall prevail to the extent of that inconsistency. For example, your ISP manages your billing and so the terms relating to the way you are billed for Fetch will not apply.
  • These Terms supplement the General Terms of Use which apply to all users of Fetch and which may be viewed from the Service at www.fetchtv.com.au/general
  • Details of current fees and charges applicable are set out at www.fetchtv.com.au/plans and also accessible by using the QR Code on your Fetch Box pack or via this link.
Terms start date These terms and conditions start when you activate your Fetch account.

Your use of Fetch indicates your acceptance of these terms and has the same force and effect as if you had actually signed these terms.

  • You may cancel Fetch at any time by accessing www.fetchtv.com.au/account. Important: If you cancel the Fetch Starter Pack, your Fetch Box will not function.

IMPORTANT - FETCH ACCESS

Effective 4 September 2026, all new accounts and any newly activated Fetch Box (including new boxes added by existing customers) must have a Fetch Access Subscription. If you do not pay the fee for the Fetch Access Subscription, your Fetch Box will not function.

  • Terms Subject to Change: Fetch can change these terms, but we have to give you at least 21 days' notice. We will endeavour to give you 30 days' notice of any price changes or material changes to content availability. However, if the change is due to something outside Fetch's control (like a technical or security issue), we might give you less notice. If a change significantly disadvantages you, you can cancel your Fetch service. The most up-to-date version of the terms is always available online at www.fetchtv.com.au/account-terms-of-use.
  • Governing Law: The laws of New South Wales, Australia, apply to this agreement.
  • Patent Notice: There are certain patents associated with Fetch.

1. Key Definitions

It's important to understand the meaning of these terms used throughout these Terms:
  • Activation Fee: A one-off fee that you pay to Fetch to activate the Fetch service. You have to pay using an Australian Visa or Mastercard. The one-off fee charged is subject to change. Current fees as set out in the Pricing List.
  • Add-On Content Pack: These are packages of Content that you can subscribe to for a fee which is charged periodically. Add-On Content Packs can be changed by Fetch with notice to you. Current fees as set out in the Pricing List.
  • Application (App): A software program you can use within Fetch or download separately (e.g., on your phone) to access content. Some Apps may require their own fees. Examples include Netflix, Stan, etc.
  • Authorised Devices: The Fetch Box itself, plus mobile phones and tablets that use specific operating systems: iOS (14.5 or later) or Android (8 or later). You have to register all devices with your Fetch account.
  • BVOD App: Broadcaster Video On Demand Apps. These let you watch free content from TV networks (like 7Plus, iView, SBS On Demand).
  • Carrier Billed: This is an arrangement where you pay for a third-party App subscription through your Fetch account, so the charge appears on your Fetch bill.
  • Content: Everything you can watch or access through the Fetch service (movies, TV shows, channels, etc.).
  • Copyright Policy: The rules for using the content on Fetch, which you can find in the Fetch settings menu or in clause d.
  • CRM Services: Services used by Fetch to manage customer relationships, like billing and payment processing.
  • Extended Service Levy (ESL): A one-off fee charged to legacy retail customers using Gen 3 hardware which is more than 5 years old and who do not pay Fetch Access or subscribe to a Content Pack or pay for Multiroom. Currently the ESL is $29.99 and covers access for a period of 12 months from the date it is charged. The purpose of the ESL is to assist to offset the rising operational costs of maintaining legacy infrastructure, platform resources, and technical support for older devices so that they may continue to access Fetch, but it does not provide additional support for third-party apps.
  • FAST Channel: Advertising Supported Channel included with Fetch Access and for which no additional subscription fee is payable to view.
  • Fetch Access: From 1 December 2025 for new Fetch customers and from 4 September 2026, for all customers, including existing customers activating a new Fetch box, this is the included content and functionality to which you will have access as a core component of the Fetch Service in return for payment of the Fetch Access Monthly Fee.
  • Fetch Access Monthly Fee: A recurring fee payable for your subscription to Fetch Access for any new account, and commencing 4 September 2026, payable for ANY NEW Fetch Box activated on or after 4 September 2026, even if you are an existing customer with an established account. The amount of the Fetch Access Monthly Fee is notified to you when you set up your Fetch account and is set out in the Fetch pricing list on the website. Current prices are subject to change with notice to you.

    For customers migrated from iiNet, your fees already include a fee equivalent to the Fetch Access Monthly Fee.

  • Fetch Box: The set-top box (either the "Mighty" or the "Mini") you need to access the Fetch Service. At present the set-top boxes available for use with Fetch are the Generation 3 and Generation 4 Mini and Mighty set-top boxes and the Generation 5 Mini set-top box. Generation 3 Set-Top Boxes and Generation 4 Mini Set-Top Boxes contain legacy hardware and some features, functions and content may be unavailable as a result.
  • Fetch Mobi App: The App (Android and iOS versions) which enables you to access specific parts of the Fetch Service on mobile devices in and out of the home.
  • Fetch Service (Fetch): The subscription entertainment service provided by Fetch and accessed via the Fetch Box and/or the Fetch Mobi App.
  • ISP: Internet Service Provider.
  • Multi-Room: The feature that allows you to have up to 3 Fetch Boxes on one account at the same address and for which a fee may be payable.
  • Pay Per View Program: A one-time event (like a sports match) that you can purchase to watch.
  • Premium Pack: means the following Add On Content Packs: Vibe, Variety, Knowledge and Kids.
  • RCU: Remote Control Unit.
  • Third Party Content Providers: Companies that provide content to Fetch (e.g., movie studios, TV networks, owners of Apps).
  • Transitioning ISP Customer: means a customer who previously obtained their Fetch Service directly from an ISP such as Optus, iiNet, and / or Vocus but agreed to become a direct retail customer of Fetch.
  • Vocus Customer: means that if you previously obtained your service from iPrimus and / or Dodo and you have signed up to become a direct retail customer of Fetch.

2. Explanation of the Fetch Service

2.1. How Fetch Works: Fetch delivers TV and on-demand content over your internet connection using a set top box (the Fetch Box).

2.2. What You Get Access to (Fees apply):

  • Live free-to-air channels, subscription channels (available as Content Packs), and FAST channels.
  • BVOD Apps (like iView) and other streaming Apps (like Netflix).
  • Movies, TV series, and other on-demand content.
  • Games.
  • Other features including a Program Guide, search and discovery.

2.3. Fetch Boxes:

  • Your Fetch Box provides access to the Fetch Service and is not intended to operate as a standalone device without a subscription.
  • Mighty: This Fetch Box has a built-in personal video recorder (PVR), so you can pause, rewind, and record live TV.
  • Mini: This Fetch Box lets you watch TV and has a reverse TV guide for catch up Tv but does not have recording capabilities.
  • You should ensure you use the Fetch Boxes in accordance with the instructions provided with the Fetch Box (and available on-screen) and with any other reasonable instructions we provide you from time to time. In order to ensure the best from your Fetch Box you should ensure you maintain it good and usable condition.

2.4. What You Need to Use Fetch:

  1. Age
    • You must be at least 18 years of age in order to establish a Fetch account. You are responsible for the use of Fetch by all persons in your household.
  2. Broadband
    • A broadband internet connection from an ISP in Australia with at least 3 Mbps speed (preferably 3.5Mbps) which is compatible with HLS (talk to your provider). Note: that using the service counts towards your data quota. If you have multiple Fetch Boxes, we recommend an additional 3 Mbps per extra box.
    • You are responsible for any data charges and data usage terms that are applied by your ISP.
    • Fetch's service quality can be affected by things outside Fetch's control, like problems with your ISP. Fetch is not responsible if the Fetch service is interrupted for these reasons.
    • Regardless of the capacity of your broadband internet connection, you receive Fetch using HLS technology. IPTV delivered via HLS traffic is not prioritised over general data. This means that video quality of the Service delivered via HLS technology could be affected by general bandwidth use of the Broadband Service. The video quality rate shifts automatically depending on the available bandwidth at the time of streaming. If there is not sufficient bandwidth to maintain a video stream, the stream will cease and a message will be displayed On-Screen notifying you that there is currently not enough bandwidth to maintain streaming.
    • It is possible that use of other electric household items can have an impact on your electrical circuit and may degrade the quality of the Service
  3. A TV and a working TV antenna (the TV antenna is to access free to air television channels. You may be able to access free to air television channels without an antenna – see below).
  4. A spare HDMI port on your TV to connect the Fetch Box. In order to ensure that your cabling configuration is correction, you may wish to use (at your discretion and cost ) a professional cable installer.
  5. Payment of the current Activation fee and your monthly subscription for Fetch Access using an Australian Visa or Mastercard. You must ensure that your card details are valid and have sufficient funds available to pay each month for the Fetch Access Monthly Fee and for any fees if you subscribe to Add-On Content Packs.

2.5. Where You Can Use Fetch:

  • Fetch is only available for use at a residential address within Australia and cannot be accessed outside of Australia or its territories.
  • If you change your address, you should notify us. We cannot guarantee that Fetch will be available at any address you move to – that will depend on the speed and quality of the broadband service.

2.6. Multi-Room Feature:

  • You can have up to three Fetch Boxes connected to a single account at your home (that is, at the same physical address) and located on the same Local Area Network LAN. An incremental 3Mbps per device is recommended for optimal Multi-Room viewing.
  • You can have more than three Fetch Boxes in your home, but each set of three requires a separate account.
  • Fees
    • Commencing on 1 February 2026 Fetch will introduce fees for the use of Multi-Room which will enable Fetch to cover some of the costs of providing this function.
    • The Multi-Room fee is set out in the Fetch pricing list on the website. Current prices are subject to change with notice to you.
    • If you are an existing customer with Multi-Room you will NOT be charged the fee unless you chose to add another Fetch Box to your account.
    • New Customers to Fetch will be charged the Multi-Room Fee if you add a another Fetch Box to your account. You are only charged one Multi-Room Fee for the total of three Fetch Boxes.
    • By continuing to use your Fetch Set-Top Boxes on or after 1 February 2026 you're agreeing to this new monthly fee. Please note, this fee is separate from any content package subscriptions you might have.

2.7. Copyright Policy Details:

  • Fetch is for your personal, home use only. You can't resell your Fetch Box t or use it for any commercial purpose. You cannot charge any person to view the Fetch service or any content on it.
  • You cannot display Fetch in a public viewing area.
  • You have to follow Fetch's copyright policy, which allows you to record some content for time-shifting (watching it later). However, you can never record movies or TV series that you rent or access through Movie Box.
  • You must use Fetch lawfully and according to this agreement.
  • Content providers can penalize Fetch if customers misuse content.
  • You must not connect to, use or authorise the use of any equipment or device which may split, record, re-encode or affect the Fetch Box or the content in the Service; and you must not tamper, override or interfere with any copyright protection device or process that we use in connection with the Fetch Box or Fetch.
  • If you violate the copyright policy or try to bypass Fetch's security, Fetch can suspend or terminate your service, and you could face legal action for copyright infringement.
  • You may have to reimburse Fetch for any losses we incur due to your breach of the Copyright Policy.

3. Activation and Payment

This section explains how you set up your Fetch service and how payments work.

3.1. Activation Process:

  • After buying your Fetch Box, you must activate your service online at www.fetchtv.com.au/activate .
  • The first step is to create a Fetch account.
  • You'll need to provide accurate and up-to-date personal information during this process. This is crucial, especially for billing purposes if you subscribe to Add-On Content Packs.

3.2. Information Required for Activation:

  • Your email address.
  • A password for your Fetch account.
  • Your customer details: This includes your place of purchase; full name, date of birth, gender, postcode, mobile phone number, and your internet service provider (ISP).
  • Your Australian credit card details: Fetch accepts Visa and Mastercard.

3.3. Account Identification:

  • Fetch may ask you for specific information to identify your account, especially for troubleshooting. This might include:
    • The 15-digit serial number of your Fetch Box.
    • Your activation code.
    • The last 4 digits of your credit card.

3.4. Privacy: (See also Section 5)

  • Fetch handles your personal information according to their Privacy Policy, which you can find at www.fetchtv.com.au/privacy-policy.

3.5. Activation Fee and Movie Credit:

  • Currently when you pay the activation fee and (for new customers, the Fetch Access Monthly Fee -see below), you automatically subscribe to the Fetch Service and as a bonus, you'll receive a Movie Credit that you can use to rent an eligible title from the Fetch Movie and TV Store within 60 days of your Activation Date. Premium Video On Demand Rentals and movie purchases are not eligible titles. Eligible titles do not display retail rental price at point of purchase.
  • This Movie Credit is a one-time offer for new customers only.

3.6. Fetch Access and Fetch Access Monthly Fee - APPLICABILITY

  • New Accounts: Customers who activate a new Fetch account must have a subscription to Fetch Access and pay the Fetch Access Monthly Fee to use Fetch.
  • New Boxes for Existing Customers (Effective 4 September 2026): Commencing 4 September 2026, the requirement to have a subscription to Fetch Access and pay Fetch Access Monthly Fee will also apply to ANY NEW Fetch Box activated on or after 4 September 2026, regardless of whether you already have an existing active Fetch account.

This modest ongoing subscription fee helps us cover the ongoing costs of keeping your Set-Top Box and the Fetch Service running smoothly and enhancing your entertainment experience. This includes important things like the licensing fees for your TV Guide (the Electronic Program Guide (EPG)) - so you always know what's on - as well as content encoding, content delivery, system maintenance, and the continuous development that brings you access to valuable features like free-to-air channels over internet, games and our growing library of free Ad-Supported Streaming TV (FAST) channels.

When you subscribe to Fetch Access you get: access to the TV Guide and universal search, 30 family friendly online games, plus other content including live and on-demand TV channels, and Movie Box with 50 on-demand movies each month and access to supported streaming apps (cost of subscriptions not included).

If the Fetch Access Monthly Fee applies to you, to ensure uninterrupted access to all these services, including your EPG, free-to-air, and FAST channels, simply keep your monthly fee up to date.

If you were formerly an iiNet Customer you already pay the Fetch Access Monthly Fee. If you were formerly a Vocus customer, most (but not all) former customers of already pay this fee. Customer transferring from Optus will be required to pay the Fetch Access Monthly Fee.

3.7. Opt-In - Promotional offers:

Fetch Ultimate:

  • 3.7.1 Eligibility: When you set up your Fetch account for the first time, as a welcome offer you are invited to subscribe to the Fetch Ultimate Pack for 30 days for no fee. The Ultimate Pack offers 40+ channels including popular channels like ESPN, Discovery and BBC Drama. Limited to one (1) free trial per customer account.
  • 3.7.2 Automatic Rollover: Upon expiration of the 1-month trial, your Fetch Ultimate Pack subscription will automatically roll over into a recurring paid monthly subscription charged at the then-current standard rate (for current prices, see website and Pricing List) unless you have cancelled your subscription. You can cancel this monthly subscription at any time via the Add More menu item on the Fetch User Interface, or by going to fetch.com.au/account and unsubscribing from the Ultimate Pack. To avoid being charged for the next billing cycle, you must cancel at least one (1) day before the renewal date. If you didn't take up your Promotional Offer at the time of setting up your account, from time to time Fetch may make this or similar Promotional Offers available.

Movie Box:

  • 3.7.3 Movie Box Promotional Offer:
    1. Eligibility: Existing Fetch Customer who do not have Fetch Access. Limited to one (1) free trial per customer account. Customers who hold an active paid Movie Box subscription are ineligible.
    2. Automatic Rollover: Upon expiration of the 1-month trial, the Movie Box subscription will automatically roll over into a recurring paid monthly subscription charged at the then-current standard rate (for current prices, see website and Pricing List), unless cancelled at least one (1) day before the trial date ends and the subscription renews in accordance with Section 3.7.2 above.

Premium Packs:

  • 3.7.4 Skinny Premium Pack Promotional Offers: Eligible Retail customers are offered a one (1) month free trial for a selected Skinny Pack channel tier.
    1. Eligibility: Existing Fetch Customers who do not have (and have never had) an active paid subscription to a Premium Skinny Pack or Fetch Ultimate. Limited to one (1) free trial of one (1) individual Premium Skinny Pack or Fetch Ultimate per customer account. Customers who currently hold, or have previously held, an active paid subscription to any Premium Pack Skinny Pack or the Fetch Ultimate Pack are ineligible.
    2. Automatic Rollover: Upon expiration of the 1-month trial, the selected Premium Pack Skinny Pack or Fetch Ultimate Pack will automatically roll over into a recurring paid monthly subscription charged at the then-current standard rate, unless cancelled at least one (1) day before the trial date ends and the subscription renews in accordance with Section 3.7.2 above.

3.8. Add-On Content Packs and Apps:

  • You can add extra channel packs (Add-On Content Packs) to your Fetch service at any time.
  • These packs are available through the Fetch on-screen menu under "Add More". (for current prices, see website and Pricing List)
  • Examples of Add-On Packs Content (as of the date of these terms) include:
    • Kids Pack
    • Vibe Pack
    • Knowledge Pack
    • Variety Pack
    • Ultimate Pack (which includes all channels from the other 4 packs)
    • Movie Box (gives you access to 50 movies per month). (For new customers paying the Fetch Access Monthly Fee, Movie Box is included).
  • These Add-On Content Packs are subject to change at Fetch's discretion - for more information, see "changes to Add-On Content Packs" in paragraph 3.11 below.
  • You can also subscribe to individual specialty channels.
  • Fetch also allows you to subscribe to certain Apps provided by third-party content providers.
  • When you subscribe to these Apps, you may need to agree to the provider's terms and conditions and set up a separate payment arrangement with them.
  • Some Apps (like Disney+, Paramount+, and Hayu) offer "Carrier Billing," (NOTE: Netflix will cease to offer Carrier Billing in October 2026); which means you can pay for the App subscription through your Fetch account. You have to agree to this option when you subscribe to the App.

3.9. YouTube Specific Terms:

  • If you use the YouTube app on Fetch, you agree to be bound by YouTube's Terms of Service and Google's Privacy Policy.

3.10. AppleTV + Specific Terms:

  • If you use the AppleTV+ app on Fetch that use is subject to Apple Pty's applicable end user license terms.

3.11. Changes to Add On Content Packs:

  • As part of Fetch's commitment to continually improve and enhance the content available on Fetch, Fetch reserves the right to change the Add On Content Packs - including removing or amalgamating packs, changing the content within each pack, the name of the Add On Content Packs and the number of Add On Content Packs available and the prices charged for the Add On Content Packs.
  • Changes may include moving you to a different Add-On Content Pack if the Add-On Content Pack to which you are subscribed is removed.
  • Fetch will endeavour to give you at least 30 days' notice of changes that are a reduction in the content line up or reductions or withdrawals to features of functions of Fetch. The notification may be one or more of the following methods:
    • via the Electronic Program Guide on the Service;
    • via the User Interface on the Service
    • on the FetchTV Website
    • by Email to the address you entered when you activated your account.
  • If you do not want to accept the change to an Add-On Content Pack, you may cancel the Add-On Content Pack.
  • The Add On Pack known as the Entertainment Pack is no longer available for subscription for new customers.
  • If you are an existing customer and you have a subscription to the Entertainment Pack you can keep your subscription.
  • If you cancel your subscription to the Entertainment Pack, then it will no longer be available to you to re-subscribe at a later date.

3.12. Fees for Add-On Content Packs and Changes to Fees:

  • You can find the current fees for Add-On Content Packs on the Fetch on-screen menu under "Add More" and see website and Pricing List.
  • See section 3.15 below for billing timing.
  • Fetch can change these fees, but we will give you at least 30 days' notice of the change using one or more of the methods set out in section 3.11 above.

3.13. Credit Card Charges:

  • You must provide your credit card details to subscribe to Fetch.
  • Your Fetch service won't be activated until Fetch confirms receipt of your Activation Fee and you've entered the Activation Code/Fetch ID.
  • Your credit card will be charged for:
    • The Activation Fee.
    • The Fetch Access Monthly Fee.
    • The Extended Service Levy if applicable.
    • Any Add-On Content Packs you subscribe to.
    • Any movies you rent or purchase.
    • Subscriptions to any Carrier Billed Apps.
    • Any other content or services that a part of Fetch for which Fetch charges are fee from time to time.
  • You can access your account and billing details online at www.fetchtv.com.au/account.
  • The Annexure to these Terms and Conditions sets out specific billing terms for Carrier Billed Apps.
  • Subscriptions to Add-On Content Packs and any Carrier Billed Apps are billed monthly in advance via automatic debit from your credit card.
  • Fetch's CRM Service Providers handle your credit card details for payment processing.
  • Movie rentals and purchases are charged to your credit card each time you make a transaction.
  • Movie prices are displayed on-screen before you confirm your purchase and are subject to change.

3.14. What Happens If a Payment Fails:

  • If Fetch can't charge your credit card for Fetch Access Monthly Fee and any monthly subscription fees:
    • You will generally receive a communication from the CRM Service Provider requesting that you update your credit card details.
    • There will be an attempt to charge your card a second time.
    • If the second attempt fails, your Fetch account will be suspended, and you won't be able to access the service until you make the payment.
  • You can reactivate your account online at www.fetchtv.com.au/account_retail.
  • You may receive a reminder when your credit card is about to expire.
  • If you change or cancel your credit card you must update your credit card details by going to Account. If you credit card is invalid your Fetch service will no longer be accessible.

3.15. Billing Timing:

    • The "Activation Date" is the date when your Fetch account is confirmed, and your first payment is received.
    • Recurring payments are calculated based on the monthly anniversary of your Activation Date ("Anniversary Date").
    • Subscription fees are billed each month commencing on your Activation Date and then monthly on Anniversary Date.
    • Billing continues until you cancel your account.
    • Fetch does not provide monthly invoices. From September 2025 you can view and print your account activity and tax invoices online at www.fetchtv.com.au/account. To obtain your monthly invoices for months before September 2025 contact Fetch at: www.fetchtv.com.au/contact-us

3.16. Cancellation Timing:

  • Cancellations take effect at the end of the month in which you cancel.
  • If you cancel an Add On Content Package you will continue to receive access to that Add On Content Package until the end of the month in which you cancelled the subscription.
  • Fetch's billing system cannot provide partial refunds for mid-month cancellations.
  • If you change packs in the same month, there might be some overlap where you pay for both packs. To avoid this, Fetch recommends unsubscribing from the first pack 3 or 4 days before your next auto-payment date, which you can find in your account's Transaction History.

3.17. Billing Issues:

  • If you have any questions or problems with your Fetch charges, log in to your account at www.fetchtv.com.au/account and go to the "billing queries" section in "support".
  • If for some reason you can't resolve the issue with Fetch, you can seek help from consumer advisory services in your state or territory.

Extended Service Levy(ESL) Eligibility and Billing Mechanics

  • From 1 November 2026, Fetch will implement an Extended Service Levy (ESL) of $29.99.

    1. Eligibility Criteria: You will be automatically liable to be charged this levy only if your account meets all of the following conditions at the time of assessment:
      1. Hardware: You are using an active, provisioned Generation 3 (Gen 3) Mini or Generation 3 (Gen 3) Mighty device.
      2. Tenure: Your Gen 3 Device is older than 5 years
      3. Subscription Status: You do not pay the Fetch Monthly Access Fee OR you do not have any active monthly Content Packs or pay the multiroom fee associated with your account.
      4. Channel: You belong to the Fetch Retail Legacy customer base (this does not apply to customers whose accounts were imported directly from an ISP partner).
    2. Purpose and Frequency: This levy is charged as a one-off fee . The fee is designed to cover the ongoing costs associated with keeping legacy devices operational for a period of 12 months from the date it is charged.
    3. Exemption and Anti-Circumvention Policy: Customers who maintain an active monthly Content Pack or Fetch Access or pay Multiroom fees are exempt from the ESL. If you subscribe to a monthly Content Pack but cancel that pack within a short timeframe, Fetch reserves the right to retroactively apply and charge the $29.99 ESL to your account upon the lapse of your subscription.
    4. Non-Payment Consequences: Payment of the ESL is a requirement in order to maintain your ability to access the Fetch Service if your device meets the legacy criteria. If Fetch cannot successfully charge your registered credit card for the ESL after standard retry attempts, your Fetch account will be suspended, and your device will lose all connectivity and functionality until the payment is cleared.
    5. If you do not wish to pay the ESL and you do not wish to take any of the steps that would exempt you from payment of the ESL, you may terminate your Fetch Service.

4. General Features of Fetch and Other User Information

This section covers the features of the Fetch service and important information about how you can use them.

4.1. Recording:

  • You can only record if you have a Fetch Mighty box.
  • Some content on Fetch cannot be recorded. This includes content from Apps, FAST Channels, rented or purchased movies, Free To Air channels delivered over the internet, and content from Movie Box. This is usually due to rights restrictions imposed by the content providers.
  • You must use the Fetch Box's recording function legally and according to Fetch's Copyright Policy (that is, for the purpose of viewing content in your household at a more convenient time).
  • Recordings saved on your Fetch Box can be lost, erased and become unrecoverable due to various reasons, including:
    • Severe weather conditions or power surges.
    • one-off software faults in the Fetch Box or network.
    • Returning a faulty Fetch Box to the retailer (you'll lose all recordings when it's exchanged).
  • You cannot back up recordings from the Fetch Box.
  • Fetch is not liable for any lost recordings.
  • Fetch may erase your recordings for several reasons, such as:
    • Content Provider agreements require it.
    • Power surges or severe weather.
    • Needing to reformat or restart your Fetch Box.
    • Upgrading to a newer Fetch Box.
    • If you use the Fetch Box otherwise than in accordance with this agreement.
  • Fetch will try to give you notice before erasing content when reasonably possible.
  • Fetch may download content, features, or software updates to your Fetch Box, which may reduce the available recording space.
  • Fetch may introduce advertisements into recorded content played back on the Fetch box.

4.2. Electronic Program Guide (EPG):

  • Fetch provides an EPG that you can view on-screen.
  • The EPG and its data are owned by Fetch or its third-party suppliers.
  • You can only use the EPG for personal, domestic use. You cannot sell, lease, copy, or distribute it.
  • Fetch does not guarantee the accuracy or completeness of the EPG. Program listings and times may be incorrect. We reserve the right to make changes to the EPG at any time without notice to you.
  • Fetch may introduce advertisements into EPG.

4.3. Fetch Movie and TV Store:

  • Movie Rental Terms of Use
    • You can rent movies from the Fetch Movie and TV Store. TV episodes are not available for rent.
    • You will be advised of the cost of the movie rental at the time of purchase. Once you confirm the purchase you cannot cancel the purchase. However, if the content is cancelled by us prior to broadcast you will not be charged for that purchase
    • Renting a movie gives you a non-exclusive, non-transferable, limited license to watch it for a specific period (usually 48 hours). This is called the Video On Demand (VOD) Rental period. Check the on-screen instructions for specific viewing periods. You cannot copy or otherwise use the movie except as specified above.
    • When you rent and watch a movie it is streamed to your Fetch Box and may result in data usage. You should refer to your broadband plans to see if this counts towards your monthly data quota (if applicable).
    • You don't gain any ownership rights in the movie when you rent it.
    • You must not try to bypass or disable any of Fetch's security or content protection measures.
    • If you violate these Movie Rental Terms, Fetch can terminate your use of the Fetch service.
  • Movie and TV Purchase
    • You can also purchase content for long-term access via the Fetch Movie and TV Store. This is called "Purchased Content".
    • Purchased Content is only available to Fetch customers in Australia and can only be viewed within Australia. Fetch uses geo-filtering to enforce this.
    • When you purchase content, Fetch grants you a limited license to stream it to your authorized devices, subject to the Device Usage Rules, during a period that commences on the day you purchase the Purchased Content and ends when your Fetch service account is terminated.
    • This license is non-transferable and depends on you complying with the terms.
    • *Important: Your license to access Purchased Content is not permanent. You must maintain your Fetch account to keep accessing it. If you cancel your account or it is terminated or suspended by Fetch, you will lose access to your purchased content, and you won't be able to recover it even if you open a new account later.

  • The Purchased Content you receive through Fetch such as movies, images, artwork and other copyrightable materials (Content) is licensed by our Content Providers or their affiliatesThe Content you receive through Fetch, including the copyrights in the Content, are owned by the Content Providers and/or their licensors, and are protected by the copyright laws of Australia and the United States, as well as other intellectual property laws and treaties. FetchTV, Content Providers and Content Providers' affiliates or licensors do not transfer any title, right or interest to or in the Content to you.
  • Movie Box:
    • Movie Box is a service that provides a package of 30 movies each month, either as part of your Fetch Access or as a separate subscription.
    • Movie Box movies are available for a limited time (usually 4 weeks), and movies are swapped out daily (one in, one out).
    • Fetch may introduce advertisements into Movie Box.

4.4. Device Usage Rules:

These are restrictions imposed by Content Providers.

  • Content from the TV and Movie Store or Movie Box can only be viewed on authorized devices registered to your Fetch account.
  • You can register up to five (5) authorized devices at a time (up to 3 Fetch Boxes and 2 other devices like tablets or phones).
  • However, you can only stream (that is, watch) Movie Content to one registered authorized device at a time, and only for personal, non-commercial use.
  • You can replace one registered device with another, up to a maximum of 10 times in any 12-month period, with no more than 2 changes per month.
  • Some Movie Content may be downloadable to your authorized devices.
  • Except for the limited licenses granted to you, you don't get any ownership rights in the content. All other rights are reserved by the content providers and copyright holders.
  • The Fetch Movie and TV Store software may track your viewing and purchasing activity and send this data to Fetch (User Behaviour Data). Fetch's Privacy Policy explains how we handle this information. By using the Fetch Movie and TV Store, you consent to this data collection.

4.5. Free to Air Channels:

There are two ways to watch Free to Air Channels on Fetch:

  • DTV Signal Access: You can access free-to-air television channels via a digital terrestrial television (DTV) signal through the Fetch Box, utilizing a connected and functioning television antenna (you are responsible for all costs associated with the antenna). To receive all digital free-to-air channels through Fetch, your billing address must be in an area that can receive a digital signal. You can check this at www.freeview.com.au or https://myswitch.digitalready.gov.au/
  • BVOD App Live Streams: Free-to-air television channels may also be accessed via IP signals through the live stream functionality of the free-to-air networks' Broadcaster Video on Demand (BVOD) apps. For example, you can watch the ABC Channels live via ABC iView. Accessing these live streams usually requires that you first sign up and log into to the relevant BVOD app. Once that is done, you can access the IP Channels directly from the Fetch EPG.

    Note: If You have a Gen 3 Mini Box, certain IP signals will not be available from the end of February 2026 as they are not able to be supported.

  • Free-to-air channels received through the Fetch Box do not form a part of the Fetch service and Fetch is not responsible for their content or reception quality.

4.6. Add-On Content Packs:

  • You can access additional channel packs (Add-On Content Packs) through Fetch for extra fees. The fee will be displayed at the time of purchase.
  • Add-On Content Packs are purchased in minimum blocks of at least one month (from time to time, the purchase period may be different), and the payment and billing details are in Section 3 (Activation and Payment).

4.7. Third Party Apps:

  • Fetch offers Apps that may change from time to time.
  • Apps are accessed through the Fetch on-screen menu.
  • Apps provide access to content from Third Party Content Providers.
  • You choose whether to access any App.
  • Fetch does not host the content in the Apps and has no control or responsibility for it.
  • You are subject to the terms of use of the specific Third Party Content Provider for each App.
  • You are responsible for choosing to access Apps and viewing content through them.
  • The availability and functionality of these Apps depend on the generation of Fetch Box used, and Generation 3 and 4 Mini boxes may be unable to launch or support certain Apps.
    • Gen 3 Mini App Compatibility:

      Certain Applications are no longer supported or were never made available on the Fetch Gen 3 Mini set-top box due to technology limitations. Specifically (referring to Apps available as at the date of these Terms):

      Unsupported: HBO Max, 7Plus, Apple TV+, SBS On Demand, Crunchyroll, Magellan TV, MySatGo, Spotify, Twitch, NBA Live Games & Scores, and DAZN are not supported on the Gen 3 Mini set top box.

      Ceasing Support: Hayu will cease to function on Gen 3 Mini on 31 August 2026; Netflix will cease to function on Gen 3 Mini on 26 November 2026; Paramount+ has advised Fetch that its Application will cease to function on the Gen 3 Mini set-top box from calendar year 2027.

    • Gen 3 Mighty App Compatibility:

      Unsupported: The HBO Max and MySatGo Applications are not supported on the Gen 3 Mighty set-top box.

      Ceasing Support: Paramount+ has advised Fetch that its Application will cease to function on the Gen 3 Mighty set-top box from calendar year 2027.

4.8. Parental Control and Personal Identification Number (PIN):

  • You are responsible for supervising use of Fetch to ensure that inappropriate Content is not accessed by minors (under the age of 18 years). Supervising may include the setting up and using parental controls to restrict access to certain content.
  • Fetch is not responsible for (and you acknowledge that Fetch is not responsible for) any inappropriate Content that may be viewed by a minor except to the extent that the viewing results directly from our own negligent act or omission.
  • Video On Demand and some channels/programs require a PIN to access.
  • You must keep your PIN secure and confidential and prevent others from misusing it.
  • On-screen instructions explain how to set up and change your PIN.

4.9. Classification:

  • You are responsible for supervising the use of Fetch to ensure minors (under 18) don't access inappropriate content.
  • This includes checking the classification ratings provided with each program.
  • You may need to use Parental Controls and/or a PIN.
  • Fetch will generally have no responsibility for inappropriate content viewed by a minor.
  • Content classifications are generally displayed with each piece of content.
  • Some non-English language content or channels may not be classified according to Australian standards, and Fetch may apply a general "M" (Mature) rating or higher.

4.10. High Definition and 4k (UHD) Viewing:

  • Some content is available in HD or 4K.
  • However, you may not always be able to view it in that quality.
  • This depends on factors like your internet connection speed, your TV's capabilities, and whether Fetch receives the content in HD or 4K.

4.11. Software – Upgrades/Ceasing Support:

  • Your use of Fetch software is subject to any end-user licenses from the software owners (including Fetch).
  • Fetch may download content, features, and software updates to your Fetch Box.
  • Fetch regularly performs software upgrades, which you cannot refuse, as the upgrades are necessary for Fetch to function properly.
  • Upgrades may occasionally affect the Fetch Box's performance. Contact Customer Support if you think an upgrade has caused a problem.
  • Older Fetch box models-such as Generation 3 and Generation 4 Mini devices-contain older hardware subject to reduced and depreciating functionality. As a result, not all features or apps available on Fetch are supported on these devices (see clause 4.7 above).

    Fetch cannot and does not represent or warrant that all software updates, content, apps, and other functionality will be fully available or optimally available on Fetch boxes older than 3 years. To ensure continuity of access, Fetch recommends upgrading your box every 3 to 5 years.

  • While Fetch actively maintains legacy infrastructure—including network compliance patches, EPG transmission, and core UI data hosting—certain legacy models (like the Generation 3 Mini) have reached the end of their feature development cycle. For these devices, the Extended Service Levy helps fund baseline connectivity, security standards, and platform integrity, but will not fund the introduction of new user features, interface overhauls, or expanded third-party app compatibility.
  • From time to time, Fetch may also cease to support older box models altogether if technical demands shift, such as when we can no longer support the latest apps or the digital rights management (DRM) required by content providers. Fetch will always try to give you as much notice as possible if this affects your device, along with options to continue using the service, such as offering you a discount on a new model.
  • From time to time, third-party application providers may independently cease supporting specific apps on older hardware due to evolving technical, hardware, or DRM requirements. Notice of planned application deprecations, including scheduled sunset dates for services like Netflix, Paramount+, and Hayu, will be communicated directly through the Electronic Program Guide (EPG) and the Fetch website.
  • From time to time, third-party Application providers will cease to support specific Applications on older Fetch Box models (such as Generation 3 Mini and Generation 3 Mighty devices) due to evolving technical, hardware, or digital rights management requirements. Notice of planned Application deprecations (including scheduled sunset dates for services such as Hayu, Netflix, and Paramount+) will be communicated via the Electronic Program Guide and the Fetch website.

4.12. Mobile Application:

  • Fetch customers can download the Fetch Mobi App for certain smartphones and tablets to watch some content and use other Fetch features.
  • You can download the Fetch Mobi App from the Apple App Store or Google Play Store by searching for "Fetch".
  • Special terms and conditions apply to the Fetch Mobi App, which you must agree to before downloading it.

4.13. Changing Fetch's Content Line-up:

  • Fetch or its Content Providers change the content on Fetch from time to time. This includes adding or removing channels, programs, features, and functionality.
  • Fetch will try to give you at least one calendar months' notice for reductions in the channel line-up or withdrawal of features.
  • Notifications may be provided through:
    • On-screen notifications.
    • Notices on the Electronic Program Guide.
    • Email.
    • The Fetch website.
  • If you have any questions or complaints, you should first contact Fetch TV via the contact details at www.fetchtv.com.au/contact-us
    • Fetch doesn't have to provide notice if changes are required:
      • By law.
      • By agreements with Content Providers.
      • For security reasons.
      • For technical reasons to protect the Fetch network.
    • However, Fetch will try to give as much notice as reasonably possible in these situations.

4.14. Customer Support and Troubleshooting:

  • Fetch is delivered over your broadband service and will not work if your broadband services is not working correctly. You will need to contact your internet service provider for all issues relating to your broadband. It is possible that Fetch quality may be affected in severe weather conditions including heavy rain, floods, electrical storms, and extreme heat.

4.15. Purchasing Fetch Remotes:

  • You can buy new or replacement Fetch remotes online through the Fetch Store: store.fetchtv.com.au.
  • Remotes are delivered by a third-party logistics provider.
  • Neither Fetch nor the logistics provider is responsible for any loss or damage to the remote if it's delivered according to your instructions.
  • You are responsible for insuring the delivery if you wish.
  • If your original Fetch remote is faulty, follow the troubleshooting instructions in the Customer Support section.
  • Remote Control and Battery Use
    1. Customer Maintenance of Batteries
      • You acknowledge and agree that the safe and proper operation of the Fetch remote control requires diligent maintenance.
      • Fetch strongly recommends that you replace all Alkaline AAA batteries (or the type specified for the accessory) every twelve (12) months to mitigate the risk of battery leakage, corrosion, and pressure-related failure.
      • You must not:
        • Attempt to recharge any non-rechargeable alkaline battery.
        • Insert batteries incorrectly (e.g., backward).
        • Expose the remote control or batteries to excessive heat or moisture.
        • Mix old and new batteries, or batteries of different types or brands, within the same device.
        • Use batteries that show signs of physical damage or leakage.
    2. Limitation on Liability
      • Fetch will not be liable for any damage, injury, or loss to your property or person caused by a battery rupture, leakage, or failure that is determined to be a result of your misuse or failure to follow the maintenance recommendations in relation to batteries set out in this clause.
      • This clause does not exclude, restrict, or modify any right or remedy that cannot be excluded, restricted, or modified under the Australian Consumer Law, including the Consumer Guarantees relating to acceptable quality, which requires that goods are safe and durable.
      • If a battery failure is found to be due to a manufacturing defect in the battery itself or a defect in the Fetch accessory that facilitates the failure (and not customer misuse), the Customer may be entitled to a remedy in accordance with the Australian Consumer Law.

5. Privacy

This section is a high level summary of the personal information which Fetch collects and uses when you sign up to and use Fetch. You must also refer to the Fetch Privacy Policy accessible at https://www.fetchtv.com.au/privacy-policy

5.1. Information Collection:

  • When you set up a Fetch account and then activate and use Fetch, Fetch (or entities authorised by Fetch) collects personal information about you.
  • This includes:
    • Your name.
    • Address (including postcode).
    • Email address.
    • Date of birth and gender.
    • Mobile phone number.
    • Credit card details (collected by Fetch's payment gateway provider).
  • Fetch may also collect information from your Fetch Box, such as:
    • The IP address of the Fetch Box.
    • The serial number of the Fetch Box.
    • Other identifiers.
    • Information about how you use the service (e.g., what you watch) – this is called "User Behaviour Data".

5.2. Use of Information:

  • Fetch may use your personal information, including User Behaviour Data, as described in the Privacy Policy, available at www.fetchtv.com.au/privacy-policy.
  • This includes authorising the payment gateway provider to access your credit card and other billing details to provide customer support services in connection with your use of Fetch.
  • Telstra customers who choose to opt-in to Telstra-specific marketing communications acknowledge that Fetch will collect and store the following personal information:
    • First and Last Name.
    • Email Address.
    • Mobile Phone Number.
    • Fetch Activation Code

5.3. Warranties:

  • You confirm that you are authorized to use the credit card you provide to Fetch.
  • You confirm that the postcode you provide matches the address where your Fetch Box will be used. This is important to ensure you receive the correct Electronic Program Guide (EPG) information.

5.4. Consent:

  • By entering into this agreement, you consent to Fetch collecting, using, and disclosing your personal information according to these terms and Fetch's Privacy Policy.

6. Suspension and Termination

This section outlines the conditions under which your Fetch service can be suspended or terminated.

6.1 Agreement Duration:

  • The agreement between you and Fetch begins on your account's Activation Date and continues until terminated.

6.2. Termination by You:

  • In addition to being able to cancel any paid subscriptions (e.g. Add On Content packs) You can cancel your agreement to receive the Fetch service at any time and for any reason.
  • If you cancel, you cannot receive a pro-rata refund for any unused portion of your pre-paid monthly subscription fees (if applicable) or your Fetch Access Monthly Fee.
  • To cancel, you must deactivate your account online at www.fetchtv.com.au/account.
  • You are responsible for cancelling your subscription. Monthly fees will continue to be charged until you deactivate your account.
  • Once you deactivate your account, you cannot access the Fetch service.
  • You will have no further access to any content which you have recorded or Purchased Content(e.g. movies).
  • Marketing Communications After Cancellation: If you have opted in to receive Fetch marketing communications (including Telstra-specific marketing), you acknowledge and agree that you may continue to receive these communications after you have deactivated or cancelled your Fetch service. Cancellation or deactivation of your Fetch account does not automatically unsubscribe you from marketing lists. You will continue to receive such communications until such time as you explicitly unsubscribe using the "unsubscribe" link provided within the footer of the marketing email or SMS.

6.3. Termination by Fetch:

  1. Fetch can immediately suspend or terminate your Fetch service if:
    • You breach these terms in a significant way.
    • You fail to pay the Extended Service Levy when due, provided your account meets the legacy criteria.
    • You misuse or attempt to misuse the Fetch service, including any unlawful activity related to intellectual property rights (e.g., illegally copying content).
    • You alter or attempt to alter the Fetch software or use Fetch in a way that infringes Fetch's or its suppliers' intellectual property rights.
    • You are identified as or become a Sanctioned Person (meaning any individual or entity subject to economic or financial sanctions or trade embargoes imposed by relevant authorities (e.g., the Australian Sanctions Office (ASO), UN, EU, UK Treasury). This includes, but is not limited to, being listed on a sanctions list, being resident in or organized under the laws of a sanctioned country, or being 50% or more owned or controlled by a Sanctioned Person or you transact business with, provides services to or receives services from, or otherwise acts for the benefit of any Sanctioned Person.
  2. You agree that you will not use any form of Artificial Intelligence (AI), Machine Learning (ML), Generative AI, Deep Learning, Large Language Models (LLMs), automated scripts, bots, or any comparable technological means (collectively, "Automated Systems") in connection with the Fetch Service to:
    • Extract, Download, Copy, or Aggregate Content:
      Extract, copy, aggregate, or download the underlying Content (including, but not limited to, films, TV shows, videos, images, or audio) made available on the Fetch Service.
    • Metadata and Data:
      Extract, copy, aggregate, or download any Metadata (e.g., descriptions, titles, cast lists, ratings, genres, release dates), Search Results, or any other Proprietary Data related to the Content or the operation of the Fetch Service.
    • Train, Develop, or Fine-Tune Automated Systems:
      Use the Content, Metadata, Search Results, or any other data obtained from the Fetch Service as training data, inputs, or for the development, fine-tuning, or benchmarking of any Automated System (including, but not limited to, LLMs or other generative models).
    • Interface with Search and Functions:
      Directly interface with, or utilize Automated Systems to conduct mass or systematic Search Queries or to interact with any other function (including user interface elements) of the Fetch Service in a manner that exceeds typical human use or is intended to circumvent usage limits.
    • Contractual and Legal Compliance:
      You acknowledge that Fetch operates under strict licensing agreements with its partners, which expressly prohibit the use of Automated Systems for the purposes outlined above. Any such use by you constitutes a material breach and may, at Fetch's sole discretion, result; in the immediate suspension or permanent termination of your access to the Fetch Service.
  3. Fetch may monitor your use of the Fetch service if we have reason to believe you are not complying with these terms.
  4. If Fetch suspends or terminates your account due to your breach, we will:
    • Notify you of their intention to terminate your access.
    • Give you an opportunity to fix the breach, if possible.
    • Your access will be restored once you have rectified the breach.
  5. If Fetch determines that your breach is serious and cannot be fixed, we may terminate your agreement immediately.
  6. Fetch may cancel inactive Fetch accounts. If a Fetch Box has been inactive for more than 12 months, Fetch may cancel the associated account.
  7. Fetch will contact you by email before cancelling an inactive account and give you 30 days to reactivate your Fetch Box if you wish to keep your account.
  8. If your account is cancelled for inactivity, you can reactivate your Fetch Box at any time by setting up a new Fetch account and paying the Activation Fee (and you'll get another free movie credit).
  9. In certain circumstances, Fetch reserves the right to suspend (but not terminate) your account. This may be whilst Fetch investigates a potential misuse of the Fetch Service. You do not have any right to suspend your Fetch account.

7. Liability

This section defines the responsibilities and liabilities of both you and Fetch.

7.1. Your Responsibility:

  • You are the account holder and as such your responsible for the actions of anyone who uses your Fetch Box and the Fetch service.

7.2. Australian Consumer Law:

  • These terms do not exclude or limit any rights you have under Australian Consumer Law, including the Competition and Consumer Act 2010 (Cth) and fair trading laws.
  • Fetch as provided to you in accordance with these Terms comes with guarantees that cannot be excluded or limited including the Australian Consumer Law or any other relevant law of the Commonwealth, a State or Territory.

7.3. Consumer Guarantees:

  • Fetch's goods and services come with guarantees under the Australian Consumer Law.
  • If Fetch has a major failure, you are entitled to:
    • Cancel your agreement with Fetch.
    • Receive a refund for any upfront fees you've paid for services you haven't used.
    • You can also claim compensation for any other reasonably foreseeable loss or damage.
  • If the failure is not considered a major failure, you can require Fetch to fix the problem within a reasonable time. If we don't, you can terminate the agreement and get a refund for unused fees.

7.4. Exclusion of Other Warranties:

  • Except for the rights you have under Australian Consumer Law, Fetch does not make any other promises or assurances about Fetch or these terms.
  • To the extent permitted by law, all other terms, conditions, and warranties (whether express or implied) are excluded.
  • For certain former ISP Customers, ownership of the Fetch Box was or may be transferred by the ISP to the relevant Customer on the basis that the customer has acknowledged and agreed that the manufacturer’s warranty on the Fetch Box has already expired at the time of transfer to ownership. Accordingly (and see clause 10), these Customers cannot rely on any manufacturer’s warranty, and their rights are limited to those remedies that remain available under Australian Consumer Law. Please refer to clause 4.14 (Customer Support and Troubleshooting) for guidance on what to do if you experience any issues with your Fetch Box.

7.5 Indemnification:

  • In addition to any other rights Fetch has, you are liable to Fetch and must protect (indemnify) Fetch, its related companies, suppliers, agents, and contractors from any losses, costs, expenses, damage, or liabilities (including legal fees) resulting from any claim or demand against Fetch by you or anyone else, arising from your use of Fetch.
  • However, you are not liable to the extent that the loss, cost, expense, damage, or other liability was caused by Fetch's or their related parties' negligence, or breach of these terms or any law.

7.6. Third-Party Content and Services:

  • Fetch is not liable for any content or services provided by third parties through the Fetch service or for any products or services advertised by third parties.

7.7. Accuracy of Information:

  • While Fetch tries to ensure the information relating to and contained on or in the Fetch service is accurate, Fetch does not make any representations or warranties as to its accuracy or completeness.

8. Intellectual Property Rights

This section clarifies who owns the intellectual property associated with the Fetch service and how you are allowed to use it.

  • Protection of Intellectual Property: Your use of the Fetch service is protected by intellectual property laws and this agreement.
  • Ownership: Copyright, trademarks, and all other intellectual property rights in all material, content, and software provided as part of Fetch remain with Fetch or its content suppliers and licensors.
  • Limited License: Fetch grants you a limited license to use these rights for your personal use of Fetch, according to this agreement.
  • Restrictions: You are prohibited from doing the following, and you cannot assist or allow anyone else to:
    • Copy, transfer, publish, rent, reproduce, record, transmit, frame, reverse engineer, decrypt, decompile, disassemble, alter, or commercially exploit the Fetch Box, its software, or any content you get through Fetch.
    • Claim to sell or charge others for watching or using any part of Fetch.
    • Show any part of Fetch in public to an audience, even if it's free.
  • License Grant: Fetch TV Retail Pty Ltd licenses the Fetch service to you for use under these terms. Fetch TV Retail Pty Ltd reserves all rights not specifically granted to you.

9. Pay Per View

PPV programs are not available as at the date of these Terms.

This section outlines the terms and conditions for using Fetch's Pay Per View (PPV) service if available.

  • PPV Availability: Fetch may offer Pay Per View (PPV) programs that you can purchase to view. Fetch does not represent that PPV programs are or will be available at any time.
  • Payment: You pay a separate fee to access and view a specific PPV program or event.
  • Promoter: The provider of the PPV event is called the "Promoter".
  • No Cancellations or Refunds: You cannot cancel your purchase of a PPV event or get a refund.
  • Age Restriction: People under 18 cannot purchase PPV events. Fetch recommends using Parental Lock to prevent children from making purchases without permission.
  • Event Changes: All PPV events are subject to change. There are no guarantees about the appearance of advertised participants or the event's location.
  • Promoter Rights: Promoters can reschedule, postpone, or cancel events at their discretion. They will try to inform customers of any changes to the advertised lineup, but the appearance of any particular participant is not guaranteed. Promoters can also discontinue any aspect of the events at any time.
  • Your Rights: Your right to access and use Fetch to view PPV events is subject to the following:
    • When you purchase a PPV event, the Promoter and/or Fetch grant you a limited, non-exclusive, and non-transferable license to view the event on your authorized devices, according to the general Terms and Conditions for Fetch.
    • You must not distribute any part of the PPV service in any medium without prior written authorization.
    • Fetch or the Promoter can terminate your access to the event if you violate the Terms of Use, any laws, rules, or regulations, or engage in conduct that Fetch or the Promoter considers inappropriate or unacceptable. This can happen at any time, without prior notice, and at their sole discretion.
    • You must comply with all applicable laws when using the PPV service.

SPECIFIC TERMS FOR TRANSITIONING ISP CUSTOMERS (INCLUDING OPTUS)

This Section 10 applies exclusively to customers who previously obtained their Fetch Service through an agreement with an Internet Service Provider (ISP)( including, but not limited to Optus)—and with the agreement of the ISP have transferred or migrated their service directly to a retail account with Fetch from 1 August 2026 ("Transitioning ISP Customers"). To the extent of any conflict or inconsistency between this Section 10 and any other provision of these Terms, this Section 10 shall prevail in respect of Transitioning ISP Customers.

10.1 Transfer of Device Ownership and Ceasing of Hire Fees
Title and legal ownership of your existing Fetch Box(es) are transferred to you from your former ISP (or Fetch, as applicable) upon successful migration. You are no longer required to return your Fetch Box to your former ISP, and any recurring monthly box hire fees previously charged by your ISP will cease upon completion of the transfer.

10.2 Fetch Access Subscription Requirement and Billing
To maintain operation of your transferred Fetch Box(es) and access core platform features (including the Electronic Program Guide, universal search, free-to-air channels over IP, FAST channels, games, and Movie Box), Transitioning ISP Customers must hold an active Fetch Access Subscription. Upon retail activation, you agree to pay the current Fetch Access Monthly Fee as set out on our website, unless your existing retail arrangement explicitly includes equivalent access fees (such as legacy iiNet transitions). Non-payment of the Fetch Access Monthly Fee will result in your Fetch Box becoming non-functional.

10.3 Warranty Exclusion and Consumer Guarantees
You acknowledge and agree that transferred Fetch Boxes are pre-owned hardware and that any former express manufacturer warranty has expired. Fetch provides no express manufacturer warranty in respect of transferred hardware. Nothing in this clause excludes, restricts, or modifies any statutory consumer guarantees or rights available to you under the Australian Consumer Law (including guarantees as to acceptable quality and durability under the Competition and Consumer Act 2010 (Cth)).

10.4 Restoration of Content Purchases and Subscription Packs
Fetch will reinstate your previously purchased digital content entitlements (such as movie and TV show purchases) and re-establish your active Add-On Content Packs (or their functional retail equivalent). Re-established content packs and ongoing Fetch Access will be billed directly by Fetch at current retail rates (including the current Fetch Access Monthly Fee where applicable) as set out in Section 3 and on our website.

10.5 Entitlement Migration Processing Time
You acknowledge that the technical migration of your account, including the full transfer and restoration of your existing digital content purchases, history, and active pack entitlements, may take up to five (5) business days to complete following your initial retail sign-up.

10.6 Authorisation to Cancel Former ISP Billing
By completing the Fetch Retail sign-up process, you expressly authorise Fetch and your former ISP to cancel your legacy Fetch service billing arrangements with that ISP. You remain responsible for any outstanding fees or charges incurred with your former ISP prior to the date of migration.

11. Complaints/ASTRA Codes of Practice

  • Fetch generally follows the codes of practice for subscription television broadcasters and narrowcasters developed by ASTRA (the Australian Subscription Television and Radio Association).

ANNEXURE A: SPECIFIC BILLING TERMS - CARRIER BILLED APPS

Carrier Billed Apps

Some third-party applications ("Apps") offered through Fetch are carrier billed. This means that while the App is provided and operated by an independent third-party provider, your subscription fee is billed through your Fetch account (or, where applicable, your Internet Service Provider bill).

  • Billing Terms & Schedules: Specific billing cycles, charge dates, retry attempts for failed payments, and cancellation rules are set and governed directly by the respective App provider. Fetch does not determine or control these terms.
  • Subscription Agreements: When subscribing to a Carrier Billed App, you may be required to agree to the individual App provider’s terms of service and payment rules.
  • Support & Inquiries: For questions regarding payment schedules, billing dates, retry policies, or managing your subscription, please contact the specific App provider directly.
  • Service Impact: Payment issues relating to a third-party App subscription will generally be managed in accordance with that provider's policies and will not affect your underlying access to the main Fetch service, unless explicitly notified otherwise during sign-up.
