Terms and Conditions for Fetch Insiders Participation

These are the terms and conditions for participation in the Fetch Insiders Group conducted by FetchTV Pty Ltd (“FetchTV”). The group may also be referred to as Fetch Insiders.

1. Acceptance of Terms

By completing your details and participating in this Fetch Insiders Group, you agree to comply with and be bound by the following terms and conditions.

2. Eligibility

Participants must have an active Fetch TV service, be 18 years of age or older and reside in Australia. Proof of age and residency may be required.

3. Email Address and other information collection

In order to participate in the Fetch Insiders Group, you will be required to provide to Fetch TV

• Your name
• a valid email address
• The serial number(s) of your Fetch set top box(es)

(your “Information”)

Your information will be collected and used by Fetch TV for:

• Sending you Fetch Insiders Group-related communications
• Providing you with access to software for use as part of the Fetch Insiders Group activities (“Software”)
• Gathering your feedback on Software and the Fetch user experience
• Notifying you of any issues, updates, or changes regarding the trial

. You can ask to be removed from the Fetch Insiders Group at any time by sending an email to insiders@fetchtv.com.au. Your information will then be deleted and you will no longer participate in the Fetch Insiders Group.

4. Privacy and Data Protection

Your Information and any other personal information collected in the course of the Fetch Insiders Group will be handled in accordance with the Fetch TV Privacy Policy.

We are committed to protecting your privacy and ensuring the security of your personal data.

5. Use of Data

The data collected during the trial, including your email address, will be used solely for the purposes of conducting the trial, improving the Software, and communicating with you. Your data will not be shared with third parties without your explicit consent, except as required by law.

6. Confidentiality

Participants agree to keep all information about the software, including features, functionality, content offering, and any issues encountered, confidential. Sharing such information publicly or with third parties is prohibited and will result in you being removed from the Fetch Insiders group.

7. Feedback

Participants are encouraged to provide feedback regarding the software. By providing feedback, you grant FetchTV a perpetual, irrevocable, royalty-free license to use, modify, and incorporate your feedback into the software without any compensation to you.

You will not receive any payment for participate in the Fetch Insiders Group but from time to time Fetch TV may offer incentives for participation in aspects of the Fetch Insiders Group activities.

8. No Warranty

The software that you will access via the Fetch Insiders Group is provided on a trial basis "as is" without any warranties, express or implied. The provider does not guarantee the performance or reliability of the Software during the trial period. Fetch TV may choose to remove your access to the trial Software at any time, and return your Fetch service to the current production version.

9. Limitation of Liability

In no event shall FetchTV be liable for any damages, including but not limited to direct, indirect, incidental, or consequential damages, arising out of or in connection with your participation in the Fetch Insiders or use of the Software.

10. Termination

FetchTV reserves the right to terminate the Fetch Insiders Group or your participation in it at any time without notice for any reason.

11. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Australia.

12. Amendments

Fetch TV reserves the right to amend these terms and conditions at any time. Any changes will be communicated to participants via the provided email address.
